Transportation: Delivery/Reception of Goods
1.1. The goods will always be sent with prepaid shipping costs, which will be included in the invoice, unless explicitly requested by the customer.
2.1. Delivery will be considered completed at the moment when the transportation company has made the package(s) available to the Customer and the Customer has signed the delivery receipt.
3.1. The Customer is responsible for inspecting the order upon receipt and stating any issues and claims that may be justified on the delivery receipt. Transport damages must be noted on the carrier’s delivery note. (There is the possibility of rejecting the delivery due to transport damage if the package is in poor condition).
4.1. Otherwise, the delivery receipt must include "PENDING REVIEW" for warranty purposes.
5.1. After a subsequent review of deliveries marked as "PENDING REVIEW" on the transport delivery note, if any anomalies/damages are found that were not visible externally, the Customer must contact MAKO PLANT within 24 hours of receiving the goods. MAKO PLANT will be responsible for replacing the items, provided that the damages are due to the product and not improper use or handling.
6.1. In case of a justified delivery error, MAKO PLANT will only accept returns of products that are unopened and/or still in their original or intact packaging.
Conditions for Changing Items
2.1. MAKO PLANT offers its customers the possibility to exchange the purchased product within seven business days from the date of purchase or delivery of the goods, provided the product has not been used, and the customer presents the purchase receipt or delivery note.
The item must be in the same condition and presentation as when it was purchased, including all accessories and intact original packaging. Similarly, any electronic and/or optical media, and in general any product containing software, must have the warranty seal intact in addition to the aforementioned conditions. MAKO PLANT reserves the right to conduct a prior examination of the goods before accepting the return.
2.2. In distance sales, in addition to meeting the above condition, the Customer must pay for the direct return shipping costs and indemnify for any damage to the product. If using a shipping company, the Customer must ensure the original packaging is not damaged, altered, or deteriorated in any way. MAKO PLANT reserves the right to conduct a prior examination of the goods before accepting the return. The Customer may request a refund by bank deposit or as a discount on a new order for the amount of the product.
3.3. LEAF LIFE WILL NOT ACCEPT RETURNS IF THE PRODUCT IS NOT IN PERFECT CONDITION.
The right of withdrawal is excluded for products with special characteristics, including those subject to market fluctuations outside the seller’s control and living matter.
3.4. The Customer may return the product in person or via a transport company. MAKO PLANT will inspect the product to verify its condition before accepting the return. The reception of returned goods does not imply acceptance or agreement with its condition; MAKO PLANT will have 15 days from receipt to notify the Customer of any damages in the returned product, for which the Customer must compensate.
4.5. MAKO PLANT is authorized to suspend and/or cancel the shipment of orders or, if applicable, terminate and/or resolve the contract, without liability for damages or losses (including lost profits), if the Customer is affected, voluntarily or involuntarily, by liquidation, insolvency, bankruptcy, lack of legal capacity, overdue payments, non-payment, or any other indication of the Customer’s financial deterioration.
Warranty Terms. Limitation of Liability.
3.1. In general, the buyer agrees to inspect the purchased item immediately and to inform MAKO PLANT of any discrepancies as soon as possible, avoiding any aggravation of damage, based on good faith.
3.2. For certain items, in addition to the rights provided to the buyer in the previous clauses, MAKO PLANT will provide the commercial warranty from the manufacturer on behalf of the producer. The warranty will be provided in writing and will include at least the information required by Article 125 of the Consolidated Text of the General Law for the Defense of Consumers and Users.
3.3. Regardless of the terms included in the warranty document, the warranty excludes defects due to improper use, poor maintenance, force majeure, and cases where the product has been tampered with by third parties before being made available to the producer or MAKO PLANT. Improper use or poor maintenance will be deemed to have occurred if the instructions contained in the manual or documentation provided with the item are not followed.
3.4. MAKO PLANT will not be responsible for consequences resulting from improper use by the Customer or any third parties, arising from failure to follow the instructions in the user manual or safety guidelines of the goods. MAKO PLANT will not be responsible for improper configuration and/or installation and/or malfunction of equipment caused by components not supplied by MAKO PLANT.
3.5. For consumable or temporary-use products, such as seeds or any living material, MAKO PLANT does not offer a warranty for quality or defects that may arise from the use of the consumable product. The Customer should contact the manufacturer directly for any defect or damage resulting from the use of such a product.
3.6. The warranty will be voided if any of the following occur: impact and/or improper transportation (by the Customer), defective installation and/or installation errors, installation and/or connection of incompatible peripheral elements, improper power supply or power surges, normal wear from use, damage due to external phenomena and/or accidents, environmental factors like humidity or abnormal conditions, and natural disasters.
Data Protection
4.1. The buyer consents to the processing of their personal data for purposes derived from their contractual relationship in accordance with the Organic Law on Personal Data Protection and other applicable regulations.
4.2. Their personal data may be included in an automated file managed by MAKO PLANT and may be shared with the manufacturer's technical services to provide after-sales service or with the manufacturer to manage product returns.
4.3. The Customer may exercise the rights of access, rectification, cancellation, and opposition at any time, by contacting the Administration Department located at Pi i Margall 114, 00815 Barcelona
